The right to privacy is an integral human right recognised and protected in the South African Constitution and in the Protection of Personal Information Act 4 of 2013 (“POPIA”). POPIA aims to promote the protection of privacy through providing guiding principles that are intended to be applied to the processing of personal or sensitive information in a context-sensitive manner.

Through its daily business activities, the company may gather and utilise information that is regarded as personal and sensitive. Information used by the company can extend to suppliers, clients, customers, employees, and other stakeholders.

The right to privacy obliges the company to ensure that it has control over all information it deals with, much of which is regarded as sensitive information. The company is therefore compelled and committed to effectively managing personal and sensitive information in a responsible manner and in accordance with POPIA’s provisions.
